The Commerce Department issued the final results of the antidumping duty administrative review on non-malleable cast iron pipe fittings from China (A-570-875) (here). Commerce assigned the only exporter under review, Overseas Industrial Corporation, to the China-wide entity, with an AD duty rate of 75.5%. The new cash deposit rate for the company takes effect May 14.

Democrats on the Consumer Product Safety Commission are not giving into pressure to drop a proposed rule that would make voluntary corrective action plans legally binding. Following criticism of the proposal from congressmen, industry and a former CPSC commissioner, the CPSC on May 12 voted 3-2 along partisan lines to reject an amendment to its midyear operating plan that would have withdrawn the proposed rule. However, CPSC Chairman Elliot Kaye noted that moving forward with a final rule is not one of his top priorities.

Black & Decker has agreed to pay a $1.575 million civil penalty for its failure to report defective lawnmowers to the Consumer Product Safety Commission, said CPSC on April 29 (here). The company had known its lawnmowers sometimes didn’t turn off or would restart spontaneously since 1998 and 2003, respectively, but didn’t report the safety hazards to CPSC until 2009, and didn’t initiate a recall until 2010, said CPSC. The penalty is Black & Decker’s sixth since 1986 for failure to report product safety defects, said the agency. Black & Decker also agreed to maintain an internal compliance program as part of the settlement, said CPSC.
