Parts of FCC's 37 GHz Order Effective July 14

Comments are due July 14 on a Further NPRM aimed at spurring greater use of the 37 GHz band, approved by FCC commissioners 4-0 in April (see 2504280032), said a notice for Thursday’s Federal Register. Replies are due July 28 in docket 24-243. Most parts of an accompanying order are effective July 14, said a second Federal Register notice. The FCC sought separate comments on the "Initial Regulatory Flexibility Analysis."

The FCC “establishes a framework to share the Lower 37 GHz band among Federal and non-Federal users,” said the notice on the order. “This framework will allow the Lower 37 GHz band to be used for a range of services through rules designed to accommodate a variety of use cases -- including backhaul and backbone links; fixed wireless broadband systems; Internet of IoT-type systems; and supplemental capacity for mobile systems.”

The agency seeks comment on three issues: “adopting a more stringent emissions limit for Upper Microwave Flexible Use Service operations above 37 GHz; whether the first phase of the coordination mechanism adopted in the companion final rule … can be enhanced by consideration of additional factors; and whether it might be possible to replace the same coordination mechanism with a dynamic spectrum management system.”
