Two Section 301 Exclusion Denial Cases From 2021 Dismissed by Plaintiffs
Two 2021 cases arguing importers' products should have been excluded from Section 301 duties were dismissed by their Houston-based law firm Oct. 1 (Anatolia Tile & Stone, Inc. v. U.S., CIT # 21-00245; Bray International v. U.S., CIT # 21-00332).
The first case, Anatolia Tile & Stone, contested the denial of exclusions for imported glass mosaic tile from China after CBP deemed importers' records insufficient (see 2306010035).
The second case, Bray International, sought exclusions for imported valve pressure relief components. Its importer argued that the products had been misclassified (see 2308010040).
Both cases were being litigated by Houston attorney Scott L. Johnston, who declined to comment.
