Commerce Extends Some AD/CVD Deadlines Due to Global Tech Outage

The Commerce Department on July 23 extended filing deadlines in various antidumping and countervailing duty proceedings by six days due to the recent global outage of Microsoft systems caused by a software update from cybersecurity firm CrowdStrike.

Commerce said the extension only applies to deadlines for "initiations as well as preliminary and final determinations and results," and doesn't cover deadlines for "actions by parties in open segments." The extension also doesn't apply to "deadlines for court-ordered redeterminations and the associated administrative (remand) proceedings," which "will continue along the same deadlines as previously established by the court and by Commerce."

The agency said the extension is "essential" since it would otherwise be impossible for Commerce's Enforcement and Compliance unit to "make up the time lost" due to the information technology outage. Commerce added that the outage is "ongoing" and agency officials "continue to experience work stoppages with no set timeline for a resolution to the operational disruption."
