Hyperlync Moves to Dismiss Suit vs. T-Mobile, Plans to Refile in State Court

Hyperlync moved to voluntarily dismiss its action against T-Mobile and Does 1-10 for lack of diversity jurisdiction because both plaintiff and defendant were incorporated in Delaware, said its motion Monday (docket 2:24-cv-00138) in U.S. District Court for Western Washington in Seattle. Hyperlync requests dismissal in order to refile in state court, it said. The suit stems from a disagreement over terms of an April 2016 master agreement involving an “Unlimited Cloud” Hyperlync was to develop for Sprint, prior to the telco's announcement it was combining with T-Mobile in April 2018 and the completion of that transaction in April 2020 (see 2402020027). T-Mobile has not yet answered the complaint, nor moved for summary judgment, the motion said.
