Trade-Related Court Cases Filed Nov. 14-20

The following lawsuits were filed at the Court of International Trade during the week of Nov. 14-20:

YETI Coolers, LLC, challenging CBP's denial of its protest claiming its vacuum vessels of Harmonized Tariff Schedule subheading 9802.00.5060 should be granted duty-free treatment since it is merchandise temporarily exported to Mexico for repairs or alterations then reimported to the U.S. #22-00325. Filed Nov. 15.

Another two lawsuits were filed at the CIT to challenge lists 3 and 4A Section 301 tariffs on products from China (see 2009220029). For a full list, see the Pacer database.

Appeals of CIT Decisions

The following appeals of Court of International Trade decisions were filed at the U.S. Court of Appeals for the Federal Circuit during the week of Nov. 14-20:

Asociacion de Exportadores e Industriales de Aceitunas de Mesa, Agro Sevilla Aceitnuas S. Coop. and Angel Camacho Alimentacion, S.L., challenging a September 2022 CIT decision that said that the Commerce Department properly found that a particular EU subsidy to Spanish olive growers was de facto specific in the countervailing duty investigation on ripe olives from Spain. #23-1162. Opened Nov. 18.
