Aug. 25 CBP Bulletin Proposes to Revoke Rulings on Flocked Paper Sets

In the Aug. 25 Customs Bulletin (Vol. 55, No. 33), CBP published a proposal to revoke rulings on flocked paper sets.

Comments on Proposals Due Sept. 24

CBP said consideration will be given to any written comments received by Sept. 24 before taking these actions. In addition, any party that has received a ruling or decision on the merchandise that is subject to the proposed revocations or modifications, or any party involved with a substantially identical transaction, should advise CBP by the date that written comments on the proposed ruling are due. (An importer's failure to advise CBP of such rulings, decisions or substantially identical transactions may raise issues of reasonable care on the part of the importer or its agents for importations subsequent to the effective date of the final decision in this notice.)

Proposals

CBP is proposing to revoke or modify the rulings below, and any rulings on these products that may exist but have not been specifically identified. CBP is also proposing to revoke any treatment it has previously accorded to substantially identical transactions.

Flocked Paper Sets

Item: Flocked paper sets containing flocked paper and an assortment of items to decorate flocked paper
Current: Subheadings 4823.90.67, 4823.90.86, 4911.91.40 and 9608.20.00
Proposed: 4811.90.90, “Paper, paperboard, cellulose wadding and webs of cellulose fibers, coated, impregnated, covered, surface-colored, surface-decorated or printed, in rolls or rectangular (including square) sheets, of any size, other than goods of the kind described in heading 4803, 4809 or 4810: Other paper, paperboard, cellulose wadding and webs of cellulose fibers: Other."
Reason: The essential character of the flocked paper sets is imparted by the flocked paper parts. Flocked paper -- which is a paper covered with flock -- is not a reproduced or printed product. The papers, which are in the form of strips and rectangular sheets, are partially covered in flock, thereby creating a decoration, and flock is the type of material that is included in heading 4811.
