BIS Partially Postpones Effective Date of New EEI Filing Requirements in Military Exports Rule

The Bureau of Industry and Security postponed the effective date for certain filing requirements outlined in an April rule on military-related exports (see 2004270027). The agency said this week it will not require Electronic Export Information filings for some exports captured under the rule until Sept. 27 -- a three-month extension from the original June 29 effective date. Other EEI filing requirements described under the rule take effect June 29.

The rule -- which was met with strong opposition from industry (see 2006150031 and 2006180036) and requests to delay it by several months -- added new license requirements to Export Control Classification Numbers and expanded EEI filing requirements for certain shipments to China, Russia and Venezuela “regardless of the value.” BIS said this week it will not require exporters to file EEI for exports controlled by ECCNs “not listed in Supplement No. 2 to Part 744” of the Export Administration Regulations until Sept. 27. But exporters will be required June 29 to begin filing EEI for items that are subject to the EAR supplement.
