India's Defense Ministry Issues 2 OGELs

India’s Ministry of Defense recently issued two open general export licenses for exports of certain parts and components and exports of intra-company transfer of technology. Both licenses authorize exports to Belgium, France, Germany, Japan, South Africa, Spain, Sweden, Britain, the U.S., Canada, Italy, Poland and Mexico.

Applications for exports of the parts and components will be considered on a case-by-case basis and requires the applicant to have a valid “IE Certificate” and a certified compliance program, and requires the applicant to agree to an on-site inspection for auditing, the notice said. The license covers certain components of ammunitions and fuse-setting devices, goods under the category for “firing control” and “related alerting and warning equipment,” goods classified as “body protective items” and more.

Applications for exports of intra-company transfers of technology include several conditions before the export can be authorized, including requirements related to where the technology was imported and a requirement that the technology did not “undergo change in functionality.” India also requires applicants to have valid IE Certificates, an approved compliance program, agree to inspections and more. The license authorizes exports of technologies or software related to items on “64010 of Munitions List,” except “complete aircraft,” “complete unarmed aerial vehicles” and other technology and software.
