AD: Chile Individually Quick Frozen Red Raspberries

The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty administrative review of individually quick frozen red raspberries from Chile for the period of July 1, 2004 through June 30, 2005.

(a) The ITA has found that the AD duty rate is de minimis for Vitafoods (0.00%), Olmue (0.01%), and VBM (0.10%). As a result, the cash deposit rates for these companies will be zero; however, suspension of liquidation will continue;

(b) For merchandise exported by manufacturers or exporters not covered in this review but covered in the original AD investigation or a previous review, the AD duty cash deposit rate will continue to be the most recent rate published in the final determination or final results for which the manufacturer or exporter received an individual rate;

(c) If the exporter is not a firm covered in this review, a previous review, or the original AD investigation, but the manufacturer is, then the AD duty cash deposit rate will be the rate established for the most recent period for the manufacturer of the merchandise; and

(d) If neither the exporter nor the manufacturer is a firm covered in this or any previous review, the AD duty cash deposit rate will be 6.33%, the "all others" rate established in the amended final determination.

Assessment Instructions for the Review Period (07/01/04 - 06/30/05)

The ITA states that it intends to issue assessment instructions for subject merchandise to U.S. Customs and Border Protection (CBP) 15 days after February 12, 2007.

Additionally, the ITA states that it calculated importer-specific duty assessment rates for subject merchandise, which trade sources note may differ significantly from the AD cash deposits rate listed above (which are weighted averages).

The ITA adds that for entries of subject merchandise during the review period produced by the respondent for which it did not know its merchandise was destined for the U.S., the ITA will instruct CBP to liquidate unreviewed entries at the "all-others" rate if there is no rate for the intermediate company(ies) involved in the transaction.
