AD: Romania Certain Cut-to-Length Carbon Steel Plate

The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty administrative review of certain cut-to-length carbon steel plate from Romania for the period of August 1, 2004 through July 31, 2005.

AD Cash Deposit Instructions for a Time of Entry on or after 02/12/07:

(a) The ITA has found that the AD duty rate is de minimis for MS Galati (0.05%). As a result, the cash deposit rate will be zero; however, suspension of liquidation will continue;

(b) For merchandise exported by producers or exporters not covered in this review but covered in the AD investigation, the AD duty cash deposit rate will continue to be the company-specific rate from the final determination;

(c) If the exporter is not a firm covered in this review or the AD investigation, but the producer is, the AD duty cash deposit rate will be that established for the producer of the merchandise for the most recent period; and

(d) If neither the exporter nor the producer is a firm covered in this review or the AD investigation, the AD duty cash deposit rate will be 75.04%, the "Romania-wide" rate established in the AD investigation.

Assessment Instructions for the Review Period (08/01/04 - 07/31/05)

The ITA states that it will issue appropriate assessment instructions directly to U.S. Customs and Border Protection (CBP) within 15 days of February 12, 2007.

The ITA adds that for entries of subject merchandise during the review period produced by MS Galati for which it did not know that the merchandise it sold to an intermediary was destined for the U.S., the ITA will instruct CBP to liquidate unreviewed entries at the 75.04% "all-others" rate if there is no rate for the intermediary involved in the transaction.
