AD: China Brake Rotors

The International Trade Administration (ITA) has issued its final results and partial rescission of the antidumping (AD) duty administrative review and notice of the rescission of the new shipper review of brake rotors from China for the period of April 1, 2004 through March 31, 2005.

(a) The ITA has found that the AD duty rate is de minimis for Meita (0.03%) and Winhere (0.01%). As a result, no AD cash deposit is required for these companies; however, suspension of liquidation will continue.

(b) The cash deposit rate for China exporters who received a separate rate in a prior segment of the proceeding will continue to be the rate assigned in that segment of the proceeding;

(c) The cash deposit rate for the China non-market economy (NME) entity will continue to be the China-wide rate (i.e., 43.32%); and

(d) The cash deposit rate for non-China exporters of subject merchandise from China will be the rate applicable to the China producer that supplied the exporter.

The ITA states that these companies are "sample rate" exporters, whose rate was calculated using proprietary information, averages and sampling exercises.

2 The ITA states that the China-wide entity includes Qingdao Rotec Auto Parts Co., Ltd. (Rotec), China National Machinery & Equipment Import & Export (Xianjiang) Corporation's exports except for those produced by Zibo Botai Manufacturing Co., Ltd. (Xianjiang/Other than Zibo), and Laizhou Huanri Automobile Parts Co., Ltd. (Huanri), as the ITA has found that they do not qualify for separate rates.

Assessment Instructions for the Review Period (04/01/04 - 03/31/05)

The ITA states that it will issue appropriate assessment instructions for subject merchandise directly to U.S. Customs and Border Protection (CBP) within 15 days of November 14, 2006.

Additionally, the ITA states it calculated importer- or customer- specific duty assessment rates for subject merchandise, which trade sources note may differ significantly from the AD cash deposit rates listed above (which are weighted averages or "sample rates").
