AD: India Certain Polyethylene Terephthalate Film, Sheet and Strip

The International Trade Administration (ITA) has issued the final results of its antidumping (AD) duty administrative review of certain polyethylene terephthalate film, sheet and strip (PET film) from India, for the period of July 1, 2004 through June 30, 2005.

The ITA notes that Jindal was formerly Jindal Polyester Limited.

(a) An AD duty rate of zero exists for MTZ. As a result, no AD cash deposit is required; however, suspension of liquidation will continue;

(b) The AD duty rate is de minimis for Polyplex (0.01%). As a result, no AD cash deposit is required; however, suspension of liquidation will continue;

(c) For previously investigated or reviewed companies not listed above, the AD cash deposit rate will continue to be the company-specific rate published for the most recent period;

(d) If the exporter is not a firm covered in this review, a prior review, or the original AD investigation, but the manufacturer is, the AD cash deposit rate will be the rate established for the most recent period for the manufacturer of the subject merchandise; and

(e) If neither the exporter nor the manufacturer is a firm covered by any segment of this AD proceeding, the cash deposit rate will continue to be 5.71%, which is the "all others" rate established in the AD investigation (24.14%), adjusted for the export subsidy rate found in the companion countervailing (CV) duty investigation.

Assessment Instructions for the Review Period (07/01/04 - 06/30/05)

The ITA states that it will issue appropriate assessment instructions directly to U.S. Customs and Border Protection (CBP) within 15 days of August 17, 2006.

Additionally, the ITA states it calculated importer-specific duty assessment rates for subject merchandise, which trade sources note may differ significantly from the AD cash deposit rates listed above (which are weighted averages).
