The International Trade Administration (ITA) has issued the final results of its countervailing (CV) duty administrative review of certain welded carbon steel standard pipe from Turkey for the period of January 1, 2004 through December 31, 2004.

(a) The ITA has determined that a final de minimis CV duty rate of 0.27% exists for Borusan; suspension of liquidation will continue, but no CV cash deposit will be required;

(b) The ITA will instruct U.S. Customs and Border Protection (CBP) to collect cash deposits for non-reviewed companies at the most recent company-specific or country-wide rate applicable to the company.

Accordingly, the CV cash deposit rate that will be applied to non-reviewed companies covered by this order will be the rate for that company established in the most recently completed CV duty administrative proceeding conducted under the Uruguay Round Agreements Act (URAA).

If such a review has not been conducted, the CV duty rate established in the most recent CV administrative proceeding completed pursuant to the statutory provisions that were in effect prior to the URAA amendments is applicable. According to ITA sources, this "All-Others" CV duty rate is 7.26%, and will apply to such companies until they receive a company-specific rate.

Sources also state that the other companies listed in the Borusan Group had various other rates prior to the instant final results. These sources add that each company listed in the Borusan Group has been assigned its own 10-digit CV case number.

Assessment Instructions for the Review Period (01/01/04 - 12/31/04)

The ITA states that it will instruct U.S. Customs and Border Protection (CBP) within 15 days of July 31, 2006, to liquidate shipments of subject merchandise by Borusan with a time of entry during the period of January 1, 2004, through December 31, 2004, without regard to CV duties.
