CV: India Certain Lined Paper Products

The International Trade Administration (ITA) has made a final affirmative countervailing (CV) duty determination that countervailable subsidies are being provided to producers and exporters of certain lined paper products from India.

Final negative critical circumstances finding. In addition, the ITA continues to find that critical circumstances do not exist with regard to exports of subject merchandise from India. (The ITA notes that it in the preliminary CV determination, it also determined that critical circumstances did not exist.)

CV suspension of liquidation/CV bond/cash requirement still discontinued. The ITA previously instructed U.S. Customs and Border Protection (CBP) to discontinue the CV suspension of liquidation and CV bond/cash deposit requirement for merchandise with a time of entry on or after June 15, 2006 (as a certain deadline had passed), but to continue the CV suspension of liquidation/bond liability for entries made between February 15, 2006, and June 14, 2006, inclusive. CBP stated that the CV suspension of liquidation will not be resumed and a CV cash deposit will not be required unless and until the ITA publishes a CV duty order. CV rates if order issued., The ITA and sources state that except for Kejriwal, if the International Trade Commission (ITC) issues a final affirmative injury determination, the ITA will issue a CV order that again suspends liquidation. The order will also require a cash deposit of estimated CV duties for entries of subject merchandise at the revised CV duty rates listed below:

(a) The ITA finds a final de minimis net subsidy rate for Kejriwal. As a result, the ITA will direct CBP to terminate the suspension of liquidation for Kejriwal's shipments of subject merchandise with a time of entry on or after February 15, 2006, and to release any bond or other security, and refund any CV cash deposit.

AD suspension of liquidation & AD cash deposit/bond requirements unaffected. CBP has previously indicated that the discontinuation of the CV suspension and CV cash deposit/bond requirements do not affect the antidumping (AD) suspension of liquidation and AD cash deposit/bond requirements for the companion AD duty investigation on certain lined paper products from India.

Note on the scope of the investigation. The scope of investigation in the final CV duty determination includes two additional HTS numbers under which the merchandise subject to this CV duty investigation may be imported-HTS 4820.10.2010 and 4820.10.2020.
