CITA Designates Certain Cotton Flannel Fabrics Used in Woven Cotton Shirts, Blouses, and Dressing Gowns as "Commercially Unavailable" Under CBTPA
The Committee for the Implementation of Textile Agreements (CITA) has issued a notice containing its determination that certain 100% cotton, yarn-dyed, 3- or 4-thread twill weave, flannel fabrics, of combed, ring spun single yarns classified in HTS 5208.43.0000 for use in products in Categories 340, 341, and 350 (woven cotton shirts, blouses, and dressing gowns), cannot be supplied by the domestic industry in commercial quantities in a timely manner under the U.S.-Caribbean Basin Trade Partnership Act (CBTPA).
Accordingly, CITA is designating products in Categories 340, 341, and 350 that are both cut and sewn or otherwise assembled in an eligible CBTPA beneficiary country from these fabrics to enter free of quota and duties under HTS 9820.11.27, provided that all other fabrics are wholly formed in the U.S. from yarns wholly formed in the U.S., subject to the special rules for findings and trimmings, certain interlinings and de minimis fibers and yarns under Section 211(b)(2)(A)(vii) of the CBTPA, and that such articles are imported directly into the customs territory of the U.S. from an eligible CBTPA beneficiary country.
(CITA's "commercially unavailable" determination for such fabrics is the result of a petition it received on behalf of B*W*A of New York, NY. See ITT's Online Archives or 03/10/06 news, 06031025, for BP summary of this petition.)
See CITA notice for weight, thread count, yarn number, weave, and finish.
