AD: China Brake Rotors

The International Trade Administration (ITA) has issued the final results of its antidumping (AD) duty administrative and new shipper reviews of brake rotors from China for the period of April 1, 2003 through March 31, 2004.

AD Duty New Shipper Review

(a) The AD duty rate is de minimis for CNIM (0.28%), GREN (0.32%), Haimeng (0.20%), Hongda (0.04%), LABEC (0.09%), Longkou TLC (0.10%), Winhere (0.31%), and ZLAP (0.17%). As a result, their AD cash deposit rate is zero; however, suspension of liquidation will continue;

(b) An AD duty rate of zero exists; however, suspension of liquidation will continue;

(c) For the final results of the AD duty new shipper review for Jinzheng, the ITA has determined that when Jinzheng is both the exporter and manufacturer of subject merchandise from China, the AD duty rate will be zero. However, when subject merchandise is exported, but not manufactured, by Jinzheng, the AD duty rate will be the China-wide all others rate of 43.32%. Bonding will no longer be permitted to fulfill security requirements for shipments of brake rotors from China that are both manufactured and exported by Jinzheng with a time of entry on or after November 18, 2005;

(d) The cash deposit rate for China exporters who received a separate rate in a prior segment of the proceeding will continue to be the rate assigned in that segment of the proceeding;

(e) The cash deposit rate for non-China exporters of subject merchandise from China will be the rate applicable to the China exporter that supplied the exporter; and

(f) The China-wide all others rate is 43.32%. This China-wide rate includes mandatory respondents Shangdong Huanri (Group) General Company and Qingdao Rotec Auto Parts Co., Ltd. which failed to qualify for a separate rate.

Assessment Instructions for the Review Period (04/01/03 - 03/31/04)

The ITA states that it will determine and U.S. Customs and Border Protection (CBP) will assess antidumping (AD) duties on all appropriate entries. The ITA states that it has calculated importer- or customer-specific AD duty assessment rates. The ITA will issue appropriate assessment instructions directly to CBP within 15 days of November 18, 2005.

The ITA will also instruct CBP to liquidate, without regard to AD duties, all entries of subject merchandise during the period of review for which the importer-specific assessment rate is zero or de minimis.
