AD: China Certain Preserved Mushrooms

Final Results of AD Duty New Shipper Review

The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty new shipper review of certain preserved mushrooms from China from one exporter/manufacturer, for the review period of February 1, 2004 through July 31, 2004.

Bonding is No Longer Permitted

As a result, the ITA states that bonding is no longer permitted to fulfill AD security requirements for shipments of subject merchandise from Blue Field with a time of entry on or after October 19, 2005.

For shipments with a time of entry on or after October 19, 2005, the ITA has determined the following AD cash deposit rates apply:

(a) The ITA has determined that for subject merchandise manufactured and exported by Blue Field, the AD cash deposit rate is zero;

(b) The AD cash deposit rate for China exporters who received a separate AD duty rate in a prior segment of the AD proceeding will continue to be the rate assigned in that segment of the proceeding;

(c) The AD cash deposit rate for the China entity and for subject merchandise exported by Blue Field but not manufactured by Blue Field will continue to be the China-wide rate of 198.63%; and

(d) The AD cash deposit rate for non-China exporters of subject merchandise from China will be the rate applicable to the China exporter that supplied that non-China exporter.

Assessment Instructions for the Review Period (02/01/04 - 07/31/04)

The ITA states that it has calculated importer- or customer-specific AD duty assessment rates based on the ratio of the total amount of AD margins calculated for the examined sales to the total entered value of those same sales. However, the ITA will instruct U.S. Customs and Border Protection (CBP) to liquate without regard to AD duties all entries of subject merchandise during the review period if the importer or customer specific assessment rate is zero or de minimis (i.e., less than 0.50 percent)

According to the ITA, it will issue appropriate assessment instructions directly to CBP within 15 days of October 19, 2005.
