AD: Thailand Canned Pineapple Fruit

The International Trade Administration (ITA) has issued its final results of the antidumping (AD) duty administrative review of canned pineapple fruit from Thailand for the period of July 1, 2003 through June 30, 2004.

AD Cash Deposit Instructions for a Time of Entry on or after 10/24/05:

(a) For previously reviewed or investigated companies not listed above, the cash deposit rate will continue to be the company-specific rate published for the most recent period;

(b) If the exporter is not a firm covered in this AD duty administrative review, a prior review, or the AD duty investigation, but the manufacturer is, the cash deposit rate will be the rate established for the most recent period for the manufacturer of the subject merchandise; and

(c) If neither the exporter nor the manufacturer is a firm covered in this or any previous review conducted by the ITA, the cash deposit rate will be the "all others" rate, which is 24.64%.

Assessment Instructions for the Review Period (07/01/03 - 06/30/04)

The ITA will issue assessment instructions directly to U.S. Customs and Border Protection (CBP) within 15 days of October 24, 2005.

Additionally, the ITA states that it has calculated importer-specific assessment rates for Vita's subject merchandise. Where such importer-specific assessment rates are above de minimis, the ITA will instruct CBP to assess the importer-specific rate uniformly on all entries made during the review period. With respect to TPC, which is receiving an AD margin based upon adverse facts available, the ITA will instruct CBP to liquidate entries according to the AFA rate.
