AD: Thailand Canned Pineapple Fruit

Initiation and Prel

The International Trade Administration (ITA) has initiated and issued its preliminary results of an antidumping (AD) duty changed circumstances review of canned pineapple fruit from Thailand.

According to the ITA, The Thai Pineapple Public Co., Ltd. (TIPCO) submitted an April 26, 2004 letter to the ITA stating that it had changed its corporate name to Tipco Foods (Thailand) Public Co., Ltd. (Tipco Foods).

The ITA states that this name change is relevant to the ongoing 2002-2003 administrative review of the AD duty order on subject merchandise from Thailand because the ITA has issued a preliminary determination to revoke the AD duty order with respect to TIPCO. (See ITT's Online Archives or 04/13/04 news, 04041335 for BP summary of the preliminary results of the ongoing 07/01/02 - 06/30/03 AD duty administrative review.)

The ITA states that after reviewing the information submitted, it has preliminary determined that Tipco Foods is the successor-in-interest to TIPCO and, as such, is entitled to TIPCO's cash deposit rate with respect to entries of subject merchandise.

Current AD Cash Deposit Requirement Continues

The ITA states that should the final results of this AD duty changed circumstances review remain the same as these preliminary results, it will instruct U.S. Customs and Border Protection (CBP) to assign Tipco Foods the AD duty cash deposit rate (and treatment) applicable to TIPCO.

- final results of AD duty changed circumstances review currently due within 270 days of May 24, 2004, or within 45 days if all parties agree to this preliminary finding

(This notice also serves as the initiation notice for this AD duty changed circumstances review. See ITA notice for more information including the scope of the review, and comment submission requirements.)
